Terms & Conditions

These Terms & Conditions (“Terms”) govern use of this landing page and any current or future subscription to Hamilton Cat Litter Co.’s Hamilton & Burlington door-step cat litter bin swap service (collectively, the “Service”). By submitting your information, joining a waitlist, or purchasing the Service, you agree to these Terms. Please review them carefully and consult counsel before launch if additional legal requirements apply to your business.

1. Eligibility & Service Area

The Service is currently available to households located within our published Hamilton and Burlington route boundaries. You must be the age of majority in your province, own or lease the property where bins will be placed, and have the authority to grant our team safe access to the pickup/drop-off location.

2. Service Description

We provide two branded, sealed bins per household. During your scheduled service window, you place the used bin at the designated outdoor location, and our technician swaps it with a clean, sanitized, and pre-filled bin of fresh litter. No in-home entry is required under the current DS1 model.

3. Plans, Pricing & Billing

  • Weekly and bi-weekly subscription options are billed in advance and subject to applicable taxes.
  • Add-ons (extra litter volume, extra bin sets, deodorizer inserts, deep cleans) may carry one-time or recurring fees, which will be disclosed before you confirm.
  • Introductory promotions, including the 10% off first three months offer, apply only to new customers and cannot be combined with other discounts unless stated in writing.
  • Pricing may change with at least 30 days’ notice. Updated rates will apply to the next billing cycle.

4. Customer Responsibilities

  • Ensure bins are accessible, visible, and placed outside before the start of your service window.
  • Use the bins only for cat litter waste (no garbage, sharps, chemicals, or other debris).
  • Keep lids closed to prevent pests and weather exposure.
  • Notify us at least 48 hours ahead if you need to skip, pause, or reschedule a visit.
  • Provide safe access (clear paths, adequate lighting, and snow/ice removal). We may decline service if conditions pose a safety risk.

5. Equipment Ownership

Bins, labels, and related materials remain the property of Hamilton Cat Litter Co.. You agree to keep them in good condition and return them within 7 days of cancellation. Replacement fees may apply for lost, stolen, or damaged bins beyond normal wear (current recommended fee: $40 per bin set).

6. Missed Visits & Additional Fees

  • If a bin is not out during your service window, the visit is marked as completed and no refund is issued.
  • We may charge a missed-pickup fee (currently recommended at $10) or offer a paid make-up visit.
  • Deep cleans, extra bin sets, and other add-ons are billed according to the then-current rate card.

7. Pausing, Cancellation & Refunds

You may pause, skip, or cancel your subscription at any time by contacting us at least 48 hours before your next scheduled service and 7 days before your next billing date. Charges that have already been processed are non-refundable, but we will stop future billing and deactivate routes once equipment is returned.

8. Service Modifications & Availability

We may adjust routes, service windows, or plan features due to weather, road closures, staffing, municipal requirements, or operational improvements. We will provide reasonable notice of material changes whenever possible. Temporary suspensions caused by events outside our control (force majeure) do not create liability.

9. Promotion & Referral Programs

Promotional codes, referral credits, or introductory pricing are subject to program-specific rules. We reserve the right to change or withdraw promotions at any time if misuse or fraud is suspected.

10. Limitation of Liability

To the maximum extent permitted by law, Hamilton Cat Litter Co. is not liable for indirect, incidental, punitive, or consequential damages arising from or related to the Service, including odours, damage caused by animals, delays due to weather, or your failure to follow the Customer Responsibilities. Our total liability for any claim is limited to the fees you paid for the month in which the issue occurred.

11. Indemnity

You agree to indemnify and hold Hamilton Cat Litter Co., its directors, employees, and contractors harmless from any claims, losses, or liabilities arising out of your misuse of the Service, violation of these Terms, or breach of applicable laws.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Hamilton, Ontario, unless both parties agree to another forum.
